Lasting Power of Attorney
Protect your wishes. Choose who makes decisions for you.
A Lasting Power of Attorney allows you to appoint people you trust to manage your finances, property, health and personal care if you are ever unable to do so yourself.
Two Vital Documents You Need While You Are Alive
There are two such documents: Lasting Powers of Attorney for Property and Affairs, which covers all your finances and property, and another called Personal Health & Welfare, covering everything to do with your personal health and wellbeing.
THESE ARE TWO OF THE MOST IMPORTANT DOCUMENTS YOU CAN HAVE WHILE YOU ARE ALIVE
LASTING POWER OF ATTORNEY PROPERTY AND AFFAIRS
If during your life something befalls you either by an accident or illness that makes you unable to handle your affairs, then your estate becomes frozen and nobody can administer anything for you or your estate. Even your spouse or children could not access anything in your name or under your control.
In many cases a government department called the Court of Protection, which is a court that acts secretly, can take over your affairs with nobody else having a say or influence over what happens. It is an awful scenario.
YOU CAN APPOINT SOMEBODY TRUSTED TO BE YOUR POWER OF ATTORNEY WHO COULD ENSURE THAT YOUR BEST INTERESTS ARE MET FOR ALL YOUR PROPERTY AND FINANCIAL AFFAIRS.
LASTING POWER OF ATTORNEY PERSONAL HEALTH AND WELFARE
This is becoming a much-needed document as people who become ill and, for example, go into care could have an official apply to that secret Court of Protection for an order on you. This would mean that nobody – not even your spouse or children – would have any control over your health and wellbeing. They could not suggest a change of room or care home, nor have any say in your day to day affairs, medical treatment, clothing, food or whether you can go out or even what television you can watch. It applies to hospital stays as well.
It has been known that where people have disobeyed the court’s orders or rulings they have been imprisoned. Seriously!
AN APPOINTED ATTORNEY WOULD HAVE THE AUTHORITY TO CARRY OUT ALL OF THESE PERSONAL HEALTH MATTERS ON YOUR BEHALF.
Note: Documents must be registered before they can be used.

The Two Types of Lasting Power of Attorney
A Lasting Power of Attorney is made up of two separate documents, each covering a different area of your life. Together, they ensure decisions can be made on your behalf if you are unable to make them yourself.
Property and Financial Affairs
Covers decisions about your finances, including bank accounts, bills, property, and investments. This can be used if you lose mental capacity or, if you choose, while you still have capacity.
Health and Welfare
Covers decisions about medical treatment, care arrangements, and daily wellbeing. This can only be used if you are unable to make these decisions yourself.
